Minutes: MPCA BOARD MEETING
Monday, July 9th, 2007
7:30 PM
The Board of Directors of the
MPCA met on Monday, July 9th at Russ Simon’s home. Present were Dimitri
Chernyshov, Fred England, Don MacKinnon, Peter Roy, Russ Simon, and Jim
Fitzpatrick, presiding. Darby Johnson and the representative of the Ridge
Association were absent. Guests included Erin Surprenant of Great North
Property Management.
The meeting was called to
order at 7:31 PM.
1. Minutes of the June
11th MPCA Board meeting:
- Motion to approve the minutes with the following
clarification was made by Peter Roy, seconded by Fred England - approved
unanimously.
- Clarification: The term “Letter of Deficiency”
used in the drainage update section of the June 11th Minutes should
be replaced with “drainage improvement plan”.
2. Treasurer’s Report
- Presented by Don MacKinnon
- The Board reviewed the May YTD financials. Year
to date expenses are as expected. Including the Special Assessment funds,
we are under the year-to-date budget by about $15,000. Expenses are
expected to end the year closer to the budget as several Water Systems
projects and the Annual View Maintenance are underway and will be
completed by fiscal year end.
- The financial reporting error in May of combining
the Operating Savings and Capital Reserve balances has been corrected and
the accounts are back to being reported separately, as required.
- Don MacKinnon presented the preliminary Operating
and Capital budget and required member fees for 2007-2008 to the Board. After
much discussion on the implications of the recent Capital study, Capital
adequacy, potential capital projects and drainage issue resolution, the
Board approved modifications to the proposed budgets. The MPCA Treasurer,
Don MacKinnon, will now meet with the Local Association Treasurers to
review the proposed budgets for their input. The budgets will then be
finalized at the August MPCA Board meeting.
3. Committee
Reports
Water Systems Committee
- Presented by Jim Fitzpatrick.
- Check Dennehy, our long time Chairman of the WSC,
is retiring from active duty. Chuck’s contributions in heading up the WSC,
making sure we had operating water and sewer systems and in recruiting
other dedicated Moody Pointers to the WSC are countless. We all owe Chuck
a huge debt of gratitude for his tireless work on these systems we depend
on. Chuck – the Board thanks you, the WSC thanks you and most importantly,
the Community thanks you!! Chuck will continue to be available on an
advisory basis.
- The WSC has determined that instead of having
Great North provide general management of the Water System as a partial
alternative to replacing Chuck’s chairmanship, they have recommended that
we purchase a new computer monitoring system (replacing the old monitoring
system that was hit by lightning and cannot be repaired or reprogrammed)
and to continue with volunteer specialists to be responsible for the major
functions of our Water & Sewer system, supported by our outside
experts – Waterline Services. As the MPCA Board’s liaison to the WSC, Jim
Fitzpatrick will chair the reconfigured WSC in the coming year.
- The WSC continues to focus on:
- Improving maintenance truck access to the pump
station: Engineering plans have been developed for designing the paved road
access to the pump station in order to have safe access for maintenance
trucks that will be needed in the future. The RFP is out for bids and the
WSC is waiting for replies.
- The problem we have with excess water inflow
into our sewer system during heavy rain events continues to be a
priority. WSC is expanding its work with experts to locate the inflow
areas and resolve the problem.
- As a result of repairing various valves in the
pump house, red water was discovered in the tanks and this will require
the tanks to be drained and checked for rust.
Environmental Committee:
- No formal report was presented. The next EC
meeting will be July 30th.
- Basic lighting has been installed in the
Screenhouse. Thanks to Dimitri Chernyshov for getting this done.
Community Life
Committee:
- No formal report was presented.
- The Summer Friday Night Happy Hours (5 PM to 7PM)
continue at the Screenhouse on Fridays. All members are invited to attend
and enjoy the serenity and each others company.
4. MPCA Managers
Report:
- Presented by Erin Surprenant
- Contacting Urban Tree to treat Poison Ivy on
Trail
- Reviewed Annual Meeting Notification Package
- Verified billable units/lots (93) and Water users
(78) in MPCA
5. Drainage Issue Report
and Update
- Presented by Russ Simon.
- We are still waiting for a response
from DES, as a follow-up to our meeting with the DES Commissioner, to
finalize the drainage improvement plan required by Walter Cheney and the
Moody Point Company.
- For Information Purposes - Walter
Cheney has written to the General Counsel of the New Hampshire Supreme
Court – Attorney Discipline Office to request that they take disciplinary
action against the MPCA’s attorney representing us on our drainage issues
(with his supporting materials), for making knowingly false statements. The
General Counsel has reviewed the request and the materials and has replied
to Mr. Cheney stating that “The materials submitted indicates a dispute
but do not support the allegations that she made knowingly false
statements of material fact or law”. Upon receiving this answer, Walter
Cheney has written to the General Counsel again asking for reconsideration
of the denial to docket his complaint.
- The Ridge Association is in the
process of cleaning out the overgrown invasives and poison ivy in the long
swale on their southern property line. They also plan on some re-grading
of the swale to eliminate the standing water in the swale and improve the
flow of water into the Fire Pond through the culvert located between 510
and 511 Cushing Road. As a result of this planned work, the MPCA drainage
channel, leading from the culvert to the Lot #4 Fire Pond will have to be
deepened/expanded to handle the expected increased in water flow. The MPCA
will be coordinating with the Ridge on this project.
6. Other Business
- View Maintenance Committee: This year’s View Maintenance work has been
completed by Earl Chase. The Committee is surveying the Associations to
determine the level of satisfaction from this year’s work and will report
the results to the Board.
- Mark Your Calendars – the MPCA Annual Meeting
will be on Saturday, September 8th, 2007. Location: Newmarket
Town Hall basement auditorium. Start Time: 9 AM. Coffee will be available
starting at 8:30 AM.
The Board Meeting was
adjourned at 10 PM.
The next regular MPCA Board
Meeting will be held at Jim Fitzpatrick’s home on Monday, August 13th,
2007 at 7:30 PM.
